This agreement sets forth the terms and conditions agreed to between you, the Client and/or service subscriber (now referred to as "the Client"), and La Frontera Media. Use of the services of La Frontera Media constitutes your agreement on all and any terms and conditions of this agreement and other supplemental policies. The terms may change without your prior notice.

Content

All services provided by La Frontera Media may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless La Frontera Media from any claims resulting from the use of the service which damages the subscriber or any other party. Any and all pornographic content and sex-related merchandising is prohibited on all La Frontera Media servers. This includes sites that may infer sexual content or links to adult content elsewhere. La Frontera Media will be the sole arbiter in determining violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to La Frontera Media servers or any other server on the Internet. Links to such materials are also prohibited. Examples of unacceptable content or links: Pirated software Hacker programs or archives Warez sites,etc... La Frontera Media will be the sole arbiter as to what constitutes a violation of this provision.

Content, Images and Media Usage & Responsibility

The Client is fully responsible for all content, images and media on the Clients' website, multimedia or printed materials. La Frontera Media shall not be held liable for any damages or loss resulting from usage for any content, images or media, no matter who supplied the content, images or media in question (whether it is supplied by the Client, La Frontera Media or a 3rd party). If the Client approves an image, media or content, the Client accepts complete responsibility of usage, regardless of which party provided said image, media or content.

Limitation of Liability

Although La Frontera Media assures that you receive a service as claimed, La Frontera Media in no way assumes ANY responsibility for ANY kind of loss associated with use of your virtual server by any cause including, but not limited to, La Frontera Media personal neglects, server failure, misuse by the subscribers or web hosting service Clients, or God's act of any other kind. By using La Frontera Media services, Clients agree to waive their rights to challenge La Frontera Media in any legal form should any loss be caused.

Representations and warranties

LA FRONTERA MEDIA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IN CONNECTION WITH THIS AGREEMENT OR THE LA FRONTERA MEDIA SERVICES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, UNLESS SUCH REPRESENTATIONS AND WARRANTIES ARE NOT LEGALLY EXCLUDABLE.

Governing Law

You agree that any action to enforce this agreement shall be brought exclusively in the United States District Court in the State Of Texas that has the jurisdiction over the area La Frontera Media is located in.

Agents and Licenses

You agree that, if you are using the services of La Frontera Media for your Client, you represent that you have the authority to nonetheless bind your Client as a principal to all terms and conditions provided herein, including the ICANN dispute Policy and the agreement of our affiliated registrars. You accept liability for any harm caused by wrongful use of the services. You agree that if you license the use of a domain name registered in your name to a third party, you shall be responsible for all obligations for the domain registration and consequences from the leased use of your domain name under this agreement.

Suspension, Cancellation, Rejection and Modification of the Services

You acknowledge and agree that La Frontera Media may suspend, cancel, reject or modify your use of the La Frontera Media services at any time, for any reason, at its own sole discretion.

Indemnification of La Frontera Media

You agree to defend, indemnify and hold harmless La Frontera Media and its holding company La Frontera Media and their personnel and affiliates for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand related to (i)your use of the domain registration, domain renewal, and registrar transfer services at La Frontera Media, and (ii) your use of any domain name registered in your name.

Governing Law

You agree that any action to enforce this agreement shall be brought exclusively in the United States District Court in the state of Texas that has the jurisdiction over the area La Frontera Media is located in.
